By accessing or using NixProtocol's website, smart contracts, documentation, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

We reserve the right to modify these terms at any time. Continued use of the Services after any changes constitutes acceptance of the new terms.

NixProtocol provides privacy infrastructure for Ethereum and EVM-compatible blockchains, including:

• Reference implementation smart contracts for encrypted balances and private transfers
• Documentation and technical resources
• Enterprise integration services (subject to separate agreements)
• Demo applications and testing environments

You must be at least 18 years old and have the legal capacity to enter into these terms. By using our Services, you represent that you meet these requirements.

You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction.

You agree NOT to use the Services to:

• Violate any applicable laws or regulations
• Engage in money laundering, terrorist financing, or other financial crimes
• Evade sanctions or facilitate transactions with sanctioned parties
• Infringe on intellectual property rights of others
• Distribute malware or engage in hacking activities
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to any systems
• Use the Services for any illegal or unauthorized purpose

Nature of Blockchain

Our Services interact with public blockchain networks. Blockchain transactions are irreversible once confirmed. You are solely responsible for any transactions you execute.

Smart Contract Risks

Smart contracts are experimental technology. While we conduct security audits and testing, no software is completely free of vulnerabilities. You acknowledge and accept the inherent risks of interacting with smart contracts.

Gas Fees

Blockchain transactions require gas fees paid to network validators. These fees are not controlled by NixProtocol and are non-refundable.

NixProtocol's privacy technology includes features for regulatory compliance, including selective disclosure and auditor access controls. Users of our enterprise services may be required to:

• Implement appropriate compliance controls
• Designate auditors with access to encrypted data when legally required
• Maintain records as required by applicable regulations
• Cooperate with legitimate law enforcement requests

The Services, including all content, features, and functionality, are owned by NixProtocol and are protected by copyright, trademark, and other intellectual property laws.

Our open-source code is licensed under specific licenses as indicated in the respective repositories. Your use of open-source components is subject to those licenses.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. You use the Services at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIXPROTOCOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless NixProtocol and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these terms
• Your violation of any third-party rights
• Your violation of any applicable laws

We may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including breach of these terms.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NixProtocol is incorporated, without regard to conflict of law principles.

Any disputes arising from these terms or the Services shall be resolved through binding arbitration, except where prohibited by law.
